Terms of Use

These Terms of Use ("Terms") govern your access to and use of ChartMath mobile and web applications (the “Services”), operated by SKAS Fintech Private Limited (“Company,” “we,” “us,” or “our”). By accessing or using the Services, you agree to be bound by these Terms.

1. Key Disclaimers

  • • For Educational Purposes Only. The Services provide tools, data, and insights for educational and informational purposes only. We are not a registered broker-dealer or investment adviser. Nothing provided through the Services constitutes investment advice, a recommendation, or a solicitation to buy or sell any security.
  • • Alerts Are Not Guaranteed. The delivery of alerts is not guaranteed and can be affected by many factors. You are solely responsible for your trading decisions and should not rely on our alerts as your only source of information.
  • • Market Data. Market data is provided by third-party licensors and is subject to their terms. You may not redistribute this data.

2. Eligibility and Account Security

You must be at least 18 years of age to use the Services. You agree to provide accurate account information and to keep your login credentials confidential. You are responsible for all activities that occur under your account.

3. Acceptable Use

We grant you a limited, non-exclusive, revocable license to use the Services for your personal, non-commercial use. You agree not to: (a) scrape, copy, or redistribute any data from the Services; (b) reverse-engineer or attempt to access the source code; (c) use the Services for any unlawful purpose; or (d) interfere with the proper functioning of the Services.

4. Fees and Billing

If we offer paid subscriptions, the fees, billing cycle, and any applicable taxes will be disclosed at the time of purchase. Subscriptions will automatically renew unless canceled. You may cancel your subscription at any time, and the cancellation will take effect at the end of the current billing period. Refunds are not provided for partial subscription periods.

5. Communications and Notifications

Consent to Receive Communications. By creating an account, you consent to receive communications from us, including:

  • • Push Notifications. If you enable push notifications on your device, we may send you alerts about screen matches, watchlist updates, discover signals, and other service-related information, as well as occasional marketing messages.
  • • Emails. We may send you transactional emails (account confirmations, password resets, security alerts) and marketing emails (product updates, educational content, research, and promotions).

Service-Related Communications. Certain communications are necessary for the operation of the Services (for example, security alerts, account notices, and important service changes). You cannot opt out of these essential communications while maintaining an active account.

Opting Out. You can control your notification and email preferences in the following ways:

  • • Push Notifications: Manage notification categories in the app settings, or disable notifications entirely through your device's operating system settings (iOS Settings or Android Settings).
  • • Marketing Emails: Each marketing email includes an unsubscribe link for that specific category. You can also manage all email preferences from within the app settings. Unsubscribe requests are honored immediately.

CAN-SPAM Compliance. All commercial emails comply with the CAN-SPAM Act and include our physical mailing address, a clear sender identification, and a functioning unsubscribe mechanism.

6. Intellectual Property

The Services and all related content, including the user interface, branding, and underlying technology, are the exclusive property of the Company and its licensors. All rights are reserved.

7. Disclaimers of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE ACCURATE, RELIABLE, OR ERROR-FREE. ANY RELIANCE ON SIMULATED OR HISTORICAL PERFORMANCE (SUCH AS BACKTESTS) IS AT YOUR OWN RISK, AS PAST PERFORMANCE DOES NOT GUARANTEE FUTURE RESULTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, OR GOODWILL, OR FOR ANY TRADING LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES.

9. Indemnification

You agree to indemnify and hold harmless the Company and its officers, directors, and employees from any claim or demand, including reasonable attorneys' fees, arising out of your violation of these Terms or your use of the Services.

10. Governing Law

These Terms shall be governed by the laws of India, without regard to its conflict of law principles.
